California Balcony Law Made Simple

Everything you need to know about SB 326 & SB 721—compliance deadlines, inspection requirements, and how we make it fast and stress-free.

It could be a matter of life and death.

A neglected or structurally compromised balcony can result in severe injuries or even fatalities—but this doesn’t have to happen in your building. Our team is here to help you prevent future issues with balcony inspections that comply with SB 326 and SB 721.

In May 2021, a balcony collapsed at a beachfront home in Malibu, California, injuring nine people. The incident occurred during a birthday party on Saturday afternoon. Witnesses described the collapse as a "freak accident" caused by a combination of the deck's structural integrity and the weight of too many people.

In June 2015, six students died in a balcony collapse during a party in Berkeley, California. The incident occurred early Tuesday morning, and at least seven others were injured. The balcony, on the fourth floor of the Library Gardens Apartments, appeared to have torn away from the building.

Don't Risk Fines or Safety Risks

  • Legal Deadlines: SB 721 (rentals) and SB 326 (HOA's /condos) require balcony/EEE inspections by December 31, 2025.

  • Consequences of delay: Non-compliance may trigger city/state fines, insurance issues, and liabilities.

  • Safety first: Timely inspections catch structural or waterproofing problems before they become disasters.

SB 721 (2017) – Apartments & multifamily rentals.

  • Balcony/EEE inspections every 6 years

SB 326 (2019) – HOA's & condominium buildings.

  • Balcony/EEE inspections every 9 years

What California Law Requires

What is an EEE?

An EEE, or Exterior Elevated Element, is any structural component on a building that:

  • Is located outside the building’s interior space and subject for pedestrian usage

  • Is elevated more than 6 feet above ground level

  • Supports weight and is designed for human occupancy

  • Balconies

  • Decks

  • Exterior Walkways

  • Cantilevered Platforms

  • Porches

  • Exterior Landings

  • Exterior Terraces or Rooms

  • Exterior Staircases / Stairways

What are some common examples of an EEE?

How to know if your EEE's are in need of inspection?

  • Is the structure 6' above the ground?

  • Does the structure contain a walking surface intended for human use or pedestrian traffic?

  • Does the structure partially or entirely rely on wood for support?

  • Is the structure exposed to weather and does it include waterproofing systems?

If you said yes to one or more of these then the chances are you're in need of an inspection!
